In response to more delays in scheduling a mark-up of ENDA, a number of national organizations issued a statement condemning the delays and calling for immediate passage of ENDA.

Senator Harkin chaired the Senate Health, Education, Labor and Pensions Committee hearing on ENDA on Thursday, November 5, 2009. The hearing opened with Tom Perez, Assistant Attorney General for Civil Rights of the Department of Justice, testifying on the Obama Administration's strong support for an inclusive ENDA. In fact, his words to begin his testimony were "It really is a privilege to testify here today and to voice the Obama Administration's strong support for fully-inclusive legislation that prohibits discrimination on the basis of sexual orientation and gender identity." Other witnesses included Illinois Attorney General Lisa Madigan, Colorado Law Professor Helen Norton, and Nike Diversity & Inclusion Team Member, Virginia Nguyen. No Senators opposed to the bill even bothered to show up at the hearing! The opposition witnesses were the same people from the House hearing: a lawyer who suggested technical changes without actually opposing ENDA, and an attorney for a religious organization.

Representative Barney Frank (D-Mass.) was joined by Representatives Baldwin (D-Wisc.) and Polis (D-Colo.) in introducing the inclusive Employment Non-Discrimination Act in the House today. The bill had 118 original cosponsors. Frank called for swift action on the bill in the House.

The Obama White House has included passage of ENDA in its Civil Rights Agenda, available on whitehouse.gov. "President Obama also continues to support the Employment Non-Discrimination Act and believes that our anti-discrimination employment laws should be expanded to include sexual orientation and gender identity."
